Contract negotiation

The negotiation of complex commercial contracts is a core capability of the company. Each member of the consulting team has been involved in the negotiation of major contracts and can draw on extensive experience in dealing with significant multinational vendors.

A major recent achievement was the negotiation of a design, construct and maintain contract with the Leighton Abigroup Joint Venture for the $2.12b Gateway Upgrade Project. The strength of the Deed and associated agreed risk allocation has seen a major piece of infrastructure delivered early, under budget, and with minimal contract dispute.

The negotiation of complex contracts with significant multinational vendors (Thales and IBM) for the design and delivery of Queensland Motorway’s new roadside and backoffice tolling systems was also a major achievement. The contracts established for the delivery and ongoing support of these systems provided a strong framework for the achievement of schedule stretch targets and highly successful operational outcomes following “go-live”.

The team has successfully negotiated a 30-year road franchise agreement with the State of Queensland for the delivery and operation of major toll roads, including construction a major landmark bridge, the upgrade of 30kms of motorway and the delivery of new tolling infrastructure.

Team members have also played significant roles in the negotiation of interoperability contracts and agreements with tolling operators across Australia.
